The Chief Judicial Magistrate, Puducherry has convicted 46 accused persons


The Chief Judicial Magistrate, Puducherry has convicted 46 accused persons viz. S/Shree Magapu Subba Rao, Dukkipati Satyanarayana, Duvva Sesha Babji, Badugu Balram, A.V.V.Sathyanarayana, Kada Pavan Prasad, Chitturi Rajesh, Medisetty Veera Arjuna Rao, Nandikolla Ganga Raju, Nimmana Surya Babu, Sreepadam Thammeswara Rao, Kanderi Sridhar, Sadanala Durga Prasad, Nookala Srinivasa Rao, Bonda Surya Bhagawan, Geddam George Victor Babu, Melakala Suryanarayana, Podugu Gopalakrishna, Raya Suryaprasad, Geddam Radhakrishna, Samana Ganga Prasad, Tekumudi Veera V.C.Sekar, Adabala Samba Siva Rao, Dhulipudi Madhava Venkanna, Kommanna Nageshwara Rao, Pesala Veera Venkatesh, Gude Durga Prasad, Pilli Appa Rao, Kodi Chinna Rao, Khaki Nageswara Rao, Yandamuri Hanumantha Rao, Chaganti Venkata Subramanyam, Kamedi Appa Rao, Adivi Naga Venkata Kondana Ramu, Jagadam Srinu, Duvvada Venkata Rao, Koppula Satti Raj, Rudra Subhramanyam, Jillela Srinivas, Kollu Srinivas, Chintapalli Appa Rao, Yella Raju, Thaninki Durgayya, Pasupulati Venkata Shivaji, Uisha Srinivasa Rao and Kondamuri Shri Hari. These 46 persons have been sentenced to undergo two years Rigorous Imprisonment for various offences including of rioting, unlawful assembly and causing hurt to deter public servant from his duty and damaging public property.

CBI had registered a case on the orders of the High Court of Madras and took over the investigation of the case from local police relating to the attack on Yanam Police Station and also on Policemen by the accused persons etc. It was alleged that on 27.01.2012, the accused persons formed themselves into an unlawful assembly and assaulted the police personnel with deadly weapons and thereby caused injuries as well as damage to Government properties, including vehicles and attempted to set fire. During the riots several Police personnel were injured and 5 police vehicles were damaged. As violence worsened, Police opened fire causing injuries to 9 persons who were part of the unlawful assembly. As per the FIR and investigation done by the local police, only 7 accused persons were arraigned as accused in this case.

During the course of investigation, the CBI had identified 84 accused persons and collected clinching evidence relating to the attack on the Yanam Police Station (on 27.01.2012).

After thorough investigation, a Charge Sheet was filed against 84 accused persons u/s 147, 148, 332, 324 r/w 149 of IPC and Section 3 of Prevention of Damage to Public Property Act (PDPP Act) before the Chief Judicial Magistrate, Puducherry on 23.09.2013. During the course of trial, 41 witnesses were examined as prosecution witnesses and 60 documents were marked as exhibits and electronic evidence containing video footage were marked by the prosecution. On conclusion of the trial, the 46 accused persons were convicted by the Court and 38 persons were acquitted.
